R1 Visa Validity

The R1 visa is a temporary, nonimmigrant visa that allows foreign religious workers to work in the United States. Its validity period is structured as follows:

1. Initial Validity

  • The initial R1 visa is granted for up to 30 months (2.5 years).

2. Extension of Stay

  • After the initial 30 months, an extension can be requested. The U.S. Citizenship and Immigration Services (USCIS) may grant an extension for an additional 30 months, allowing for a maximum stay of 5 years in total.

3. Maximum Stay

  • The total maximum stay on an R1 visa is 5 years (60 months). This includes the initial period and any extensions.

4. Recapturing Time

  • If the visa holder leaves the U.S. for extended periods, they may be able to “recapture” that time to extend their total stay beyond 5 years, but only for the time they spent outside the U.S. during their visa’s validity.

5. Permanent Residency

  • R1 visa holders may be eligible to apply for a green card (permanent residency) during their stay, allowing them to continue residing in the U.S. beyond the 5-year limit if their application is approved.

It is important to note that the R1 visa is intended for temporary religious work, and the applicant must demonstrate their intent to return to their home country after their visa expires, unless they transition to another immigration status.
